These Terms and Conditions together with any engagement letter, service agreement, or written instructions accepted by Pikul Legal, which collectively govern the relationship between you and us.

Pikul Legal, a legal services practice with its principal office at 89 Beach Road, Pattaya City, Bang Lamung, Chonburi 20150, Thailand.
"You", "User", "Client"
Any individual or entity who accesses this website, submits an enquiry, or engages Pikul Legal for any of the services described herein.

The legal counsel and advisory services offered by Pikul Legal relating to pension matters, including but not limited to Initial Pension Consultation, Pension Recalculation Request Preparation, and Disability and Early-Retirement Pension Counsel.

3. Service Description

Pikul Legal provides legal counsel and advisory services focused on pension rights and pension defence in Thailand. Our current service offering comprises:

Initial Pension Consultation

A structured first appointment in which we review your pension circumstances and provide a written summary of available paths. Priced at ฿2,600 per appointment.

Pension Recalculation Request Preparation

Formal preparation of a recalculation submission to the administering authority, including documentation review and drafting. Priced at ฿4,400.

Disability and Early-Retirement Pension Counsel

Counsel and representation for clients pursuing pension entitlements on grounds of disability or qualifying early retirement. Priced at ฿7,600.

All services are provided subject to availability. We reserve the right to decline instructions at our professional discretion where we consider it appropriate to do so. The Website provides information only and does not itself constitute legal advice.

4. User Responsibilities

When using this Website or engaging our Services, you agree to:

  • Provide accurate, complete, and truthful information in all communications with us.
  • Promptly notify us of any changes to information that you have previously provided.
  • Respond to reasonable requests for documents or clarification within agreed timeframes.

6. Payment Terms

Our fees are denominated in Thai Baht (฿) and are set out in our service schedule:

  • Payment is due prior to commencement of each service, unless otherwise agreed in writing.
  • We accept payment by bank transfer and such other methods as we may notify from time to time.
  • All fees are inclusive of applicable value-added tax where required by Thai law.
  • Where additional work is requested beyond the scope originally agreed, a revised fee will be discussed and agreed before that work commences.
  • Fees paid for consultations are non-refundable once the appointment has taken place. If you need to reschedule, please contact us at least 24 hours in advance.

7. Service-Specific Terms

The following terms apply to the delivery of our legal services:

7.1 Scope of Engagement

The scope of each engagement will be set out in a written summary or engagement letter provided to you following initial consultation. Work outside that agreed scope will not be undertaken without a separate agreement on fees and terms.

7.2 Client Obligations

We rely upon the information and documents you provide. The quality of our advice depends on the completeness and accuracy of that material. We are not responsible for outcomes adversely affected by information that was withheld, inaccurate, or provided late.

7.3 Confidentiality

We treat all client information as confidential and subject to professional legal privilege, subject to any mandatory disclosure obligations under Thai law. We will not share your information with third parties except where necessary to carry out the services or where required by law.

7.4 Timeframes

We will endeavour to meet any timeframes agreed with you. However, timescales may be affected by the availability of documents, responses from third-party authorities, and factors outside our control. We will keep you informed of material delays.

7.5 Third-Party Decisions

Our services involve submissions to and proceedings before pension authorities and related bodies. The decisions of those bodies are entirely independent of Pikul Legal and are not within our control.

8. Disclaimers

This Website and its Content are provided for general informational purposes. Nothing published on this Website constitutes legal advice, and reading it does not create a solicitor-client or adviser-client relationship between you and Pikul Legal.

9. Limitation of Liability

To the fullest extent permitted by Thai law:

  • Our aggregate liability to you in connection with any engagement shall not exceed the total fees paid by you for that engagement.
  • We shall not be liable for any indirect, consequential, or special loss, loss of profit, loss of anticipated savings, or loss of opportunity, whether arising in contract, tort, or otherwise.
  • We shall not be liable for failure or delay in performing our obligations where such failure or delay arises from circumstances beyond our reasonable control, including but not limited to administrative delays by third-party authorities, natural events, or changes in law.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded under applicable Thai law.

10. Indemnification

You agree to indemnify and hold harmless Pikul Legal and its personnel from and against any claims, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Website, or your provision of false or misleading information. This indemnity does not apply to claims arising from our own negligence or wilful misconduct.

11. Termination

By you: You may discontinue use of this Website at any time. If you wish to terminate an engagement, please notify us in writing. Fees for work already completed or substantially in progress will remain payable.

By us: We reserve the right to cease acting for a client where there is a professional reason to do so — for example, where there is a conflict of interest, where instructions are unclear or repeatedly changed, or where required payments have not been received. We will provide reasonable notice and will take steps to minimise prejudice to your position.

Effect of termination: Clauses relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive any termination of this Agreement.

12. Dispute Resolution

12.1 Governing Law

These Terms and any engagement with Pikul Legal are governed by and construed in accordance with the laws of the Kingdom of Thailand.

12.2 Jurisdiction

Any disputes arising out of or in connection with these Terms or an engagement that cannot be resolved informally shall be subject to the exclusive jurisdiction of the Thai courts with competence over the relevant subject matter.

12.3 Informal Resolution

Before commencing formal proceedings, both parties agree to make a genuine effort to resolve any dispute informally through direct communication. Please contact us at [email protected] with a written description of your concern. We will respond within 14 days.

13. General Provisions

Entire Agreement: These Terms, together with any engagement letter or written instructions, constitute the entire agreement between you and Pikul Legal in respect of your use of the Website and the Services.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver: Failure to enforce any provision of these Terms on a particular occasion shall not constitute a waiver of our right to enforce it on a future occasion.

Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations in connection with a transfer of our business.

14. Changes to These Terms
